Electronic Signature Consent

This Electronic Signature Consent ("E-Sign Consent") applies to all electronic communications and transactions between you and ClickSKU ("Company," "we," "us," or "our"). This consent is provided in accordance with the Electronic Signatures in Global and National Commerce Act (E-Sign Act, 15 U.S.C. § 7001 et seq.) and the Uniform Electronic Transactions Act (UETA).
1. Consent to Electronic Communications
By creating an account or using the ClickSKU platform, you consent to receive all communications, agreements, disclosures, notices, and documents from us electronically, including but not limited to:
- Terms of Service and Privacy Policy (and any updates thereto)
- Subscription confirmations, receipts, and billing statements
- Payment confirmations and invoices
- Account notifications (password changes, role changes, security alerts)
- Service announcements, updates, and maintenance notices
- Support and customer service communications
- Any amendments or modifications to our legal agreements
2. Consent to Electronic Signatures
You agree that clicking "I Agree," "Accept," "Create Account," or similar buttons, or checking acceptance checkboxes on the ClickSKU platform, constitutes your electronic signature. Your electronic signature carries the same legal force, validity, and enforceability as a handwritten signature.
You acknowledge and agree that electronic signatures are legally binding under the E-Sign Act and UETA, and that you will not contest the validity or enforceability of any agreement or transaction on the basis that it was conducted electronically.
3. Hardware and Software Requirements
To access and retain electronic records provided by ClickSKU, you will need the following:
- A device (computer, tablet, or smartphone) with a current, commercially available internet connection.
- A current, up-to-date web browser that supports TLS 1.2 or higher (e.g., Google Chrome, Mozilla Firefox, Apple Safari, or Microsoft Edge — current versions).
- A valid, active email address to receive notifications and communications from us.
- Sufficient storage space on your device, or access to a printer, to save or print electronic records for your personal files.
- A PDF viewer (e.g., Adobe Acrobat Reader or equivalent) if we provide documents in PDF format.
By consenting, you confirm that you have the necessary hardware, software, and internet access to receive, view, and retain electronic records.
4. How to Withdraw Your Consent
You may withdraw your E-Sign Consent at any time by contacting us at ghemmeinc@gmail.com with a clear written statement of your intent to withdraw.
Please note the following consequences of withdrawal:
- Because the ClickSKU platform is delivered entirely electronically, withdrawing E-Sign Consent may make it impossible for us to continue providing the Service to you. In such cases, your account may be suspended or terminated.
- Withdrawal of consent does not affect the legal validity or enforceability of any electronic signatures, agreements, or records made prior to your withdrawal.
- Any fees already charged are not refundable solely on the basis of consent withdrawal.
5. Requesting Paper Copies
You may request paper copies of any electronic record or communication by emailing us at ghemmeinc@gmail.com. We will provide the first paper copy free of charge. Subsequent paper copies may be subject to a reasonable processing and mailing fee, which we will communicate to you before fulfilling the request.
6. Updating Your Contact Information
You are responsible for keeping your email address and other contact information current and accurate. You can update your contact information through your ClickSKU account settings or by contacting us at ghemmeinc@gmail.com.
If we are unable to reach you at the email address on file, we may suspend your account until valid contact information is provided.
7. Acknowledgment
By creating a ClickSKU account, you confirm that:
- You have read and understand this E-Sign Consent.
- You consent to receiving all communications, agreements, and records from ClickSKU electronically.
- You have the required hardware, software, and internet access described in Section 3.
- You understand how to withdraw your consent as described in Section 4.
- You agree that your electronic signatures are legally binding.
